Nesbyen tourist office/booking reserves the right to change prices in the event the State’s provisions with respect to fees are changed. When fees are changed, the lessor automatically has the right to change his/her prices with respect to offers that have been made and offers that have already been booked.
1. The rental arrangement
1.1 The booking order is binding on the parties once made in writing, orally or electronically (by means of the Internet, e-mail or a mobile telephone text message). Written confirmation of the booking will be promptly sent to the lessee.
1.2 A cancellation insurance policy will be offered at NOK 295 per accommodation when the booking is made. The protection is made valid if it should become necessary to cancel an agreement due to acute illness, accidental injuries or death. The rental sum can be returned, if tenant or tenants closest family, is stricken (i.e. spouse/cohabitant, children, parents and grandparents). Documentation through a medical certificate must be submitted for having the rental sum returned, and NOK 500,- in administration fee will be deducted. When 2 or more families travel together, the protection covers each familiy`s share of the rental sum. The Cancellation Protection only includes the rental sum for the rental object booked. Read more about the terms and conditions of this in the section on cancellations.
1.3 Should there be discrepancies in the written confirmation, Nesbyen tourist office/booking is bound for five (5) days by the content of the confirmation sent. The lessee can, in as far as these discrepancies are not acceptable, cancel the lease agreement in writing before the deadline, i.e. within 5 days.
1.4 The lessee may demand and transfer rights and duties with respect to the agreement to a third person up until the stay begins. If a third person enters into the agreement, he or she will be liable with the lessee for payment of any possible outstanding amounts that arise as a result of the transfer. Administration fee NOK 300,-.
1.5 In the event of online booking, the stay is confirmed and paid for online with a credit card/invoice, pursuant to the payment terms conditions.
2. Payment terms and conditions
2.1 When a leasing agreement is entered into, Nesbyen tourist office/booking will send confirmation of this to the lessee.
2.2 If the booking is made earlier than 3 months before arrival, 50% of the cost of the stay and the cancellation fee must be paid within 10 days of the booking. The remainder falls due at the latest 6 weeks before arrival.
2.3 If the booking is made later than 3 months before arrival, the entire rental amount is due 10 days after the booking is made.
2.4 If the rental amount is not paid by the due date, Nesbyen tourist office/booking may cancel the leasing agreement without a warning. Nesbyen tourist office/booking considers lack of payment as breach of contract and the lessee does not have the right to demand performance of the contract.
2.5 Prices are in Norwegian kroner (NOK).
3. The accommodation
3.1 Nesbyen tourist office/booking does not own the residential units. It manages the leasing relationship between the parties concerned.
3.2 The confirmation will contain the residential unit’s name, a description of its contents and directions to it as well as contact information for checking-in and -out, the final cleaning and rental of linens.
3.3 The number of people living in the residence must not exceed the maximum number of people designated in the description. Should this number be exceeded, the lessor/owner may turn the number of people in excess away.
3.4 Check-in after 16.00. Check-out before 12.00. When checking out, the key must be delivered to the same place it was obtained.
3.5 The lessee is responsible for cleaning the unit. When leaving, the unit and all furnishings shall be cleaned and rubbish deposited in the nearest container for this purpose.
3.6 A final cleaning service may be ordered/booked for an extra fee. If the lessee orders final cleaning, the unit is to be vacated in a tidy state, dishes washed, tables and benches cleaned and rubbish placed in the nearest container for this purpose.
3.7 Final cleaning is obligatory in certain units. In these cases, cleaning is included in the rental price and this is noted in the confirmation. Preparations before vacating the unit described in sub-section 3.6 shall nonetheless be carried out.
3.8 Electricity is included in the rent. Firewood is included in the rent for some units; this is noted in the confirmation.
3.9 Certain units require a security deposit to ensure that the lessee fulfils his/her obligations and this is included in the rental price. The deposit covers return of key(s), payment for additional services such as provision of firewood and so forth, as well as compensation in the case of damages/breakage or an inadequate final cleaning. Repayment of the deposit is settled about a week after the departure date.
3.10 Pets are allowed in some residence units and this is noted on the website, as well as in the confirmation. Certain units charge for dogs – the fee is to be paid on arrival and information about this is included in the confirmation. The lessee undertakes to inform about dog(s) when making enquiries/ordering.
3.11 Nesbyen tourist office/booking is not liable for errors in the unit descriptions or prices given.
4. Cancellation
Lessee’s cancellation in the case of paid cancellation fee:
Before the beginning of the stay, the lessee at any time may cancel the agreement giving reason in writing to Nesbyen tourist office/booking. The cancellation is considered valid when it has arrived and is in hand at Nesbyen tourist office/booking. The following fees will be charged and will normally cover Nesbyen tourist office/booking’s expenses and claims for compensation:
4.1 For cancellations up to 60 days before the beginning of the stay, 15% of the total amount, in any case a minimum of NOK 500.
4.2 For cancellations between 59-30 days before the beginning of the stay, 50% of the total amount, in any case a minimum of NOK 500.
4.3 For cancellations from the 29th day until the arrival date or later, and in the case of no arrival: 100% of the total amount/or specified agreement.
4.4 Unused services cannot be claimed for reimbursement.
Lessor’s cancellation:
Nesbyen tourist office/booking can terminate the agreement in the following instances:
4.5 The lessor/owner can require the lessee to leave if the lessee mismanages or neglects the unit, or disturbs public law and order. In such cases, Nesbyen tourist office/booking has a right to compensation, in addition to the rent and deposit, amounting to the total expenses incurred. Any extra expenses in connection with travel home shall be paid by the lessee.
4.6 Checking-in takes place after 16.00. Should unforeseen events make the unit uninhabitable, Nesbyen tourist office/booking will endeavour to find alternate accommodation. Nesbyen tourist office/booking will endeavour to find the best possible accommodation, but nonetheless cannot guarantee the same standard. The lessee shall pay the same price, or less, if the alternate accommodation has a lower price than that originally booked.
4.7 If the lessee does not pay the rent by the deadline, Nesbyen tourist office/booking may cancel the agreement. In these cases, cancellation fees as mentioned in section 6 apply.
5. Changes
Nesbyen tourist office/booking will accommodate the lessee’s wishes for changes to the agreement up to 60 days before arrival. Nesbyen tourist office/booking charges a change fee for this of NOK 500. Later changes can only be made as a cancellation of the leasing agreement pursuant to the provisions mentioned in section 4 and a simultaneous new order.
6. Force majeure
If the stay cannot take place due to force majeure (e.g. war, labour strikes, lockouts, rationing of petroleum products, closure of boarders, epidemics, natural catastrophes or contamination catastrophes etc.), both Nesbyen tourist office/booking and the lessee may cancel the leasing agreement. If the agreement is cancelled by the lessee, Nesbyen tourist office/booking can require proportional compensation for expenses related to the cancellation of the stay.
7. Illness
The lessee must bear expenses related to illness that are incurred during the stay. This also applies to outlays for any possible necessary transport of the lessee home. If the lessee’s state of health is worrisome, Nesbyen tourist office/booking recommends that he/she visit a doctor before booking. We recommend that the lessee purchase cancellation insurance without excess. This may be purchased from an insurance company.
8. Deficiencies
8.1 Should there be problems or should anything be missing, the lessee shall get in touch with the owner/contact person given in the confirmation.
8.2 The lessee can claim compensation for residential unit deficiencies that have been reported no later than 24 hours after arrival if the deficiency is not corrected within a reasonable amount of time, and has inconvenienced the lessee during his/her stay. The lessee shall present a written claim/explanation to Nesbyen tourist office/booking within 3 days after departure to invoke a legal claim. If this is not done, the lessee loses the right to claim compensation.
